Controversial Issues in NEC Contracts: An Update - 1st November 2018

The NEC contracts are characterized by their radical departure from existing building and engineering contracts, being written in plain language and targeted to promote rather than frustrate good management.

However, the implementation of the NEC contracts in Hong Kong is not without controversies, particularly due to the amendments of the standard forms by the works departments of the HKSAR government, which are the major clients in Hong Kong adopting the NEC forms. In fact, more amendments have been made since the last offer of this CPD course in October 2017.

From the increasing usage of the forms, more and more controversial issues arise which are said to end up with insensible or even unfair results, and which have attracted debates amongst practitioners in the construction industry. Typical examples of these include the contractual provision to exclude the Contractor's site management from the Defined Cost in the assessment of compensation events; and whether partially completed works should be assessed and certified in interim certificates. There is also the controversy on whether the Contractor can still resort to common law remedy for contractual breaches, on top of the remedy already provided in the NEC.

Because of the increasingly common usage of the NEC3 in Hong Kong, many stakeholders in the construction industry may have already come across briefing sessions and introductory talks regarding the features of the standard forms and how they can be put into use in construction projects.

This course differs from the ordinary introductory talks on NEC contracts in that it places particular emphasis on the practical but controversial issues arising from the use of the NEC3 ECC Option A, B, C and D in the local context. The speakers will share their thoughts on these on the basis of their personal experiences as practitioners in the field acting as NEC advisors.

In order to provide a better grasp and understanding by the course participants of the controversial issues involved, the course will be presented in a Q&A format with contentious issues frequently encountered being put into a question mode, and with possible answers suggested for discussion in an interactive environment.  Particular emphasis will be placed on the early warning system, the Project Manager’s power in making instructions, the contractual implication of the Accepted Programmes, the arrangement of interim payments, the compensation event mechanism, and matters relating to completion and defects.
