Construction Claims: From Theory to Practice - 15th March 2019

Claims are inevitable in every construction project. Some may be dealt with satisfactorily during the course of the contract while others may develop into arbitration or litigation. Based on the instructors' experience, many of these construction claims could have been handled more effectively if parties to the claims appreciate and understand the theory more thoroughly and implement the same more comprehensively in practice. It is thus the aim of this CPD course to bring home the essential and fundamental theories concerning typical construction claims and the applications of these theories in real-life practical scenarios.

Leading classical case authorities covering areas of delay to completion, extension of time, time-bar and limitation period, BQ error, valuation of variation orders, delay and disruption claims, prolongation claims, interpretation of contractual clauses, liquidated damages, non-payment, re-fixing of rates, repudiation of contracts etc. will be covered in the CPD course.

Having grasped the theories as enshrined in the leading case authorities, real-life scenario questions will be provided to the participants for applying the theories to practice. It is through this application and analyzing process, the participants would be able to appreciate and get the most out of the case authorities.

In order to make the seminar more lively and interactive, it is suggested that participants may submit scenario questions well in advance so that their real-life problems could be discussed during the CPD course. Such an interactive forum, in the opinion of the instructors, proves to be the most effective way of conveying the theories to the participants. However, the questions may only be discussed on general basis if they are too complicated. Depending on the number of questions received, there is no guarantee that the question must be covered in the CPD course.
